1. Introduction

These Terms and Conditions govern your access to and use of the Queensland Saab Club Inc. website (the Website) and your participation in club membership and activities. Queensland Saab Club Inc. (the Club) is an incorporated association registered under the Associations Incorporation Act 1981 (Qld) and regulated by the Queensland Office of Fair Trading.

By accessing the Website, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the Website.

2. Definitions

In these Terms and Conditions:

Act — the Associations Incorporation Act 1981 (Qld)

Club — Queensland Saab Club Inc.

Constitution — the Constitution of Queensland Saab Club Inc.

By-laws — the By-laws adopted by the Club under Rule 42 of the Constitution

Member — a person admitted to membership of the Club in accordance with the Constitution and these By-laws

3. Permitted Use of the Website

You may use the Website for lawful purposes only. You agree not to:

upload, transmit or distribute any unlawful, threatening, abusive, defamatory, obscene, offensive or otherwise objectionable material

disrupt the normal flow of dialogue within the Website or intentionally damage the Website

use the Website for any commercial purpose without prior written consent of the Club

attempt to gain unauthorised access to the Website or related systems or networks

harvest or collect information about other users of the Website without their consent

engage in any form of harassment, bullying or discriminatory behaviour

4. Club Membership Application and Eligibility

Queensland Saab Club Inc. is a private, invitation-only association. Membership is considered a privilege rather than an entitlement.

4.1 Invitation to Apply

Prospective members may only apply after receiving an invitation from the Management Committee or from a member authorised by the Management Committee. An invitation to apply does not guarantee admission as a member.

4.2 Application Process

All membership applications remain subject to approval by the Management Committee in accordance with the Constitution. The Management Committee is not required to provide reasons for declining an invitation or rejecting an application.

4.3 Membership Standards

Members are expected to contribute positively to the reputation, culture and objectives of the Club. Members must:

demonstrate respect towards fellow members

support Club activities where reasonably able

preserve the welcoming and respectful atmosphere of the Club

act in a manner that reflects positively on the Saab marque and the Club

5. Constitution and By-Laws

5.1 Binding Agreement

By submitting a membership application and upon admission to membership, you agree to be bound by the Constitution and By-laws of Queensland Saab Club Inc., as amended from time to time. These documents are available on the Club Website or from the Club secretary.

5.2 Key Provisions

You acknowledge that the Constitution and By-laws contain provisions concerning:

membership rights, obligations and termination

conduct of Club runs, events and activities

driver behaviour and vehicle safety requirements

the Club's invitation-only membership model and maximum membership numbers

use of the Club logo and design assets

governance, committee roles and dispute resolution

disciplinary procedures and grounds for termination

5.3 Updates to Constitution and By-Laws

The Management Committee may amend the Constitution and By-laws in accordance with the Associations Incorporation Act 1981 (Qld). Members will be notified of any material changes and will be bound by updated documents from the date they come into effect.

6. Privacy and Personal Information

The Club collects, holds and manages personal information in accordance with the Club's Privacy Policy. By using the Website and applying for membership, you consent to the collection and use of your personal information as outlined in the Privacy Policy.

6.1 Information Collected

The Club may collect:

name, postal address, email address and phone number

membership category, joining date and renewal status

vehicle details relevant to club activities and events

payment details for membership fees and event registrations

7. Club Events and Activities

7.1 Official Club Events

An event is an official Club event only if approved by the Management Committee or a person authorised by the Committee. Members must not describe unofficial gatherings as official Club events without approval.

7.2 Participation Requirements

Participation in Club events is open to all current financial members unless otherwise approved by the Management Committee. Members may participate using a Saab vehicle, another roadworthy vehicle owned by the member, or another vehicle approved by the event organiser.

7.3 Vehicle Safety and Insurance

Every driver is responsible for ensuring their vehicle is:

registered where required by law

roadworthy

insured where legally required

compliant with all applicable road laws

The Club arranges public liability insurance cover for events. This does not cover individual vehicles or third-party damage claims.

7.4 Driver Conduct

Members must conduct themselves responsibly while participating in Club activities. Drivers must obey all road rules, drive courteously, avoid dangerous or competitive driving, avoid excessive speed, and not consume alcohol or drugs that impair driving. Club runs are not races, timed events or competitions unless specifically authorised.

7.5 Safety

Safety is the responsibility of every participant. Members must follow organiser instructions, supervise children under their care, report hazards to organisers, and use appropriate personal protective equipment during workshops. Event organisers may refuse participation where a person presents an unacceptable safety risk.

7.6 No Liability

The Club accepts no responsibility for traffic infringements, damage to vehicles or property, or personal injury resulting from a member's participation in Club activities or driving.

8. Intellectual Property and Use of Club Logo

8.1 Club Logo and Design Assets

The Club logo and design assets remain the property of Queensland Saab Club Inc. Members may use the logo and design assets only with approval of the Management Committee or for approved Club purposes.

8.2 Prohibited Use

The logo and design assets must not be:

altered without approval

used for political purposes

used to endorse commercial products without approval

used in a manner likely to damage the reputation of the Club

8.3 Merchandise

Merchandise bearing the Club name or logo may only be produced with Committee approval. Members may not commercially reproduce Club merchandise without written approval. Any profits from merchandise belong to the Club.

8.4 Website Content

All content on the Website, including text, images, graphics and logos, is the property of Queensland Saab Club Inc. or its content providers and is protected by copyright. Reproduction or distribution of Website content without permission is prohibited.

9. Social Media and Member Communications

9.1 Member Conduct on Social Media

Members are encouraged to promote the Club positively on social media. When using social media, members must:

be respectful and avoid abusive, defamatory or discriminatory comments

avoid publishing confidential Club information or membership details

clearly express personal opinions as their own and not as Club positions

not describe unofficial gatherings as official Club events

9.2 Official Club Pages

Official Club social media pages may only be administered by persons authorised by the Management Committee. The Committee may remove administrators or moderate content where necessary to protect the interests of the Club.

9.3 Member Conduct Standards

Members must avoid behaviour likely to bring the Club into disrepute. Persistent disruptive behaviour, harassment, intimidation, aggressive conduct or behaviour inconsistent with the values of the Club may result in disciplinary action under the Constitution.

10. Disclaimer of Liability

10.1 Website Content

The Website and its content are provided on an "as is" basis without warranties of any kind, express or implied. The Club does not warrant that the Website will be uninterrupted, error-free or free from viruses or malicious code.

10.2 External Links

The Website may contain links to external websites. The Club is not responsible for the content, accuracy or practices of external websites. Your use of external websites is at your own risk and subject to their terms and conditions.

10.3 Limitation of Liability

To the extent permitted by law, the Club is not liable for any loss or damage (including loss of profits, data or business opportunities) arising from your use of the Website or participation in Club activities, even if the Club has been advised of the possibility of such loss.

11. Disciplinary Procedures and Membership Termination

11.1 Grounds for Disciplinary Action

The Management Committee may take disciplinary action against members who:

breach the Constitution or By-laws

engage in conduct that brings the Club into disrepute

harass, intimidate or discriminate against other members

fail to comply with safety requirements or driver conduct standards

breach confidentiality obligations regarding membership information

misuse Club property, logos or intellectual property

11.2 Disciplinary Process

Disciplinary procedures will be conducted in accordance with the Club's Constitution and the grievance procedure adopted under the Club's rules. Members will be given an opportunity to respond to allegations before any decision is made.

11.3 Potential Outcomes

Disciplinary action may result in:

a written warning

suspension of membership for a specified period

termination of membership

12. Limitation of Invitations and Membership Numbers

The Management Committee may determine a maximum membership number at any time and may suspend invitations or applications if it considers the membership has reached an appropriate size. The Club is under no obligation to recruit or replace members.

13. Amendment of Terms and Conditions

The Club may amend these Terms and Conditions at any time. Amendments will be published on the Website, and continued use of the Website constitutes acceptance of the amended terms. You should review these Terms and Conditions regularly for updates.

14. Governing Law

These Terms and Conditions are governed by the laws of Queensland, Australia, and are subject to the Associations Incorporation Act 1981 (Qld). The club's Constitution takes precedence where any conflict arises between these terms and the Constitution.

15. Dispute Resolution

Any disputes arising from membership or use of the Website will be resolved in accordance with the grievance procedure adopted under the Club's Constitution and rules. Members agree to exhaust internal dispute resolution procedures before pursuing any external action.

16. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision will be removed and the remaining provisions will continue in full force and effect.
